Understanding Protected Persons and Canadian Immigration
According to the Immigration and Refugee Board (IRB) and Citizenship and Immigration Canada (CIC), individuals who are granted refugee protection are referred to as protected persons.
How Can You Determine If You Are a Protected Person?
You can request a letter of determination from the IRB or CIC if you fall into any of these categories:
- Foreign nationals needing protection, as determined by the IRB.
- Foreign nationals recognized as convention refugees by the IRB.
- Foreign nationals who receive a positive Pre-Removal Risk Assessment (excluding those covered under section 112(3) of the Act).
- Foreign nationals belonging to the Humanitarian-Protected Persons Abroad classes.
- Foreign nationals who are members of the Convention Refugees Abroad class.
Can a Protected Person Apply for Permanent Residency in Canada?
Yes, protected persons can apply for permanent residency in Canada. However, in some cases, you may not qualify if:
- You are a Convention Refugee from another country where you can live safely and without fear of persecution.
- You are a citizen or permanent resident of another country where you can live safely, except for the country you fled.
Once protected persons become permanent residents or Canadian citizens, they can apply for a travel document without needing a status document.
