Humanitarian and Compassionate (H&C) Applications
H&C applications allow individuals to apply for permanent residency in Canada based on humanitarian and compassionate grounds. These are outlined under Section 25 of the Immigration and Refugee Protection Act (IRPA).
Who Can Apply?
Eligibility to apply under H&C grounds may include factors such as:
- Having family members who are permanent residents or citizens of Canada
- Being employed in Canada, with or without a valid work permit
- Studying in Canada, with or without a valid study permit
- Volunteering in Canada
- Demonstrating language proficiency in English or French
- Owning property or having savings in Canada
- Having social connections within the community in Canada
Even if an applicant does not have legal status in Canada, they may still be able to apply under this program.
Application Process for H&C
Applicants must show they would face significant hardship or negative consequences if required to leave Canada. Most H&C applications are made from within Canada, and the applicant’s personal situation is assessed.
A detailed letter explaining why the applicant is applying under H&C grounds is crucial. Strong supporting documents are key, as H&C applications are discretionary, and the immigration officer will use their judgment in the decision-making process.
Some applicants, like failed refugee claimants, may have to wait 12 months before applying, although certain exemptions exist.
